Utah's Car Accident Laws and How They Affect Your Case

In Utah, the amount of compensation you can recover from a car accident is governed by two laws: no-fault and modified comparative fault. 

A No-Fault Jurisdiction

Utah law requires that before you can sue another individual, personal injury protection (PIP) insurance must cover your injuries unless they include:

  • Death
  • Dismemberment
  • Permanent disability
  • Permanent disfigurement
  • Medical expenses exceeding $3,000

Modified Comparative Fault

This rule allows you to collect damages from any driver more at fault for the accident than you are.

The court will decide what percentage of fault each party involved has concerning the accident. How much you are able to collect is directly connected to how much fault you share in the accident. 

For example, the court determines you are 20 percent at fault for the accident and the other driver 80 percent at fault. If you suffered $10,000 in damages, the court would award you $8,000.

Time Limits for Filing a Claim

In Utah, there are several statutes of limitations for car accident cases.

  • 1 year to sue a county, city, or town
  • 2 years to pursue a wrongful death or personal injury case against the State
  • 3 years for a personal property damage case
